Workers
Compensation laws were developed in the early 20th century to
allow workers injured on the job prompt payment for medical
expenses incurred, and a portion of lost wages. No longer would
workers have to wait for long drawn out court cases to get help.
The payment was much more assured - the court case may have been
lost - but large financial settlements as compensation were also
no longer possible. Companies similarly no longer had to fight
cases in courts but also gave up the possibility of putting the
blame on the worker or coworkers, or raising the concept of
“accepted risk”. Workers Compensation is essentially a no
fault system and instead of being fought in the courts, disputes
are handled by an administrative body.
